What is Personal Injury Law?

Accidents are an unfortunate part of life, but when they happen, personal injury law is what gives victims the right to seek compensation for their losses. This legal framework essentially defines who is allowed to file a personal injury lawsuit, as well as what evidence they need to present and the amount of compensation they should receive if they win their case.

Personal injuries can be a result of negligence or an intentionally harmful act, and there are a few key aspects to personal injury law that every potential victim should be aware of.

Duty of Care

The duty of care is a legal obligation that requires both individuals and businesses to exercise caution and care in everything they do, especially if the situation could potentially cause harm to others.

One common example of the duty of care involves wet floors: everyone has seen a wet floor sign at some point in their life. Businesses display these signs to warn their customers that the floor is wet and to be cautious when walking on it. While the business could choose to mop the floor without posting a ‘wet floor’ sign, this would be an example of them breaching their duty of care to their customers.

Most personal injury lawsuits require the plaintiff to prove that the defendant failed to uphold their duty of care in order to win their case.

Damages

Another key aspect of personal injury law is the idea of damages. Damages are the compensation that a plaintiff receives after winning a personal injury case. These damages are meant to cover a wide variety of different losses and are usually split up into three different types.

  • General Damages: This type of damages compensates a victim for non-economic harm, including physical pain, psychological or emotional distress, and reductions in quality of life.
  • Special Damages: This type of damages compensates a victim for easily quantifiable economic losses, including lost wages, medical bills, property damage, and any future costs that may come along with the personal injury.
  • Punitive Damages: This type of damages is awarded when the defendant acted in a particularly reckless or malicious manner and is meant to punish the defendant and discourage others from acting similarly in the future. Punitive damages are by far the least common type of damages.

What Are Personal Injury Attorneys?

A personal injury attorney is a type of lawyer who specializes in personal injury law. Personal injury lawyers are experts in Tort Law, and their primary focus is on representing personal injury victims so that they can receive compensation for their losses.

In addition to simply representing their clients, personal injury attorneys also perform a wide variety of other key tasks that can help their clients win their cases. From filing the initial paperwork and providing legal advice to gathering evidence and witness testimonies, negotiating with insurance companies, and consulting experts, personal injury lawyers utilize all of their resources and expertise to ensure that their clients have everything they need to get the compensation that they deserve.

Our Personal Injury Specialties

Personal injury cases are some of the most common lawsuits that Pennsylvania residents file, and they cover a wide variety of different injuries. From motor vehicle accidents to medical malpractice cases and everything in between, all of these different types of personal injuries require specific knowledge and expertise that some lawyers possess and others don’t.

We know that if you are the victim of a personal injury, you want to be able to ensure that you choose a Chester County personal injury lawyer who has the specific experience necessary to obtain the best results possible.

Here at HoeyLegal, we specialize in representing clients who are the victims of many of the most common types of personal injury cases. Chances are that if you have a personal injury, our team has the knowledge and expertise necessary to win.  However, if you still aren’t sure if we’re the right law firm for you, here are all of our personal injury specialties.

Car Accidents

No one ever gets in their car expecting to get into an accident, but that doesn’t make car accidents any less common. The average American will get into 3 to 4 car accidents in their lifetime, and when those accidents happen, you need to know that you have an expert personal injury lawyer to represent you.

From simple accidents to those caused by drivers under the influence, car accidents often cause debilitating injuries that can change the course of one’s life in an instant. No matter how severe your injuries or how high your medical bills are, we’ve won countless car accident cases for our clients over the years, so you can trust that your case is in the best hands possible.

Motorcycle Accidents

For bikers, there’s nothing more freeing than the feel of the open road. The only problem is that motorcycle drivers are particularly vulnerable when out on the road, and often don’t get the respect that they deserve.

Reckless drivers often feel that they can bully motorcycle drivers around and, in many cases, simply don’t pay enough attention to bikers on the road. If you’re a biker, we hope that you never have to worry about getting into a serious accident, but if you do, you can count on our team here at HoeyLegal to have your back to the very end.

Trucking Accidents

Trucking accidents tend to be some of the most traumatic and deadly motor vehicle accidents on the road. For this reason, the trucking industry faces heavy regulation, and truckers must follow a wide variety of different safety measures to ensure that everyone out on the road stays safe.

Our team has extensive experience with trucking accidents and is well acquainted with all of the rules and regulations surrounding the industry. This means that if you are ever involved in an accident with a large freight truck, you’ll be able to rest easy knowing that HoeyLegal is uniquely qualified to ensure that you get the maximum compensation for your losses.

Nursing Home Negligence

We trust our nursing homes to take care of our most vulnerable loved ones. While most nursing homes offer high-quality service and have the best interests of their residents in mind, there are still plenty of opportunities for accidents to happen and negligent actors to slip through the cracks.

From ignoring health symptoms and failing to call doctors for residents who need medical attention to simply failing to provide a clean and comfortable environment for their residents to live out their golden years, all of these situations and more are more common than most want to believe.

If you or your loved one has been the victim of nursing home negligence, we offer our most heartfelt condolences, and we will do everything we can to make sure that the victim gets compensation for their suffering.

Slips and Falls

Not every slip and fall is a personal injury case. However, if you slip and fall on someone else’s property due to their failure to keep their property safe and secure, you could have a personal injury case on your hands.

Property and building owners have a responsibility to keep their premises safe. This is why you often see “Wet Floor” signs in stores after mopping, and why business owners need to keep their sidewalks and parking lots clear of snow and ice. If you fall due to their failure to uphold any of these or similar responsibilities, our legal team will always be here to help.

Medical Malpractice

Injuries and disease are an unfortunate fact of life, but luckily, modern medicine has gotten pretty good at helping the sick and injured recover. That being said, medical professionals are only human and can make the occasional mistake that leads to prolonged suffering, adverse side effects, and even death.

Our legal team possesses extensive medical malpractice expertise and has access to highly qualified medical consultants who provide us with an extra edge that we can use to win your case. As soon as you suspect you may be a victim of medical malpractice, contact us, and we’ll do everything we can to ensure that the medical professional is held responsible.

Crime Victims

Not every personal injury is the result of negligence. From assault and robbery to sexual assault, domestic violence, and more, some personal injuries are due to deliberate acts by criminals.

Whether you were a premeditated target or simply in the wrong place at the wrong time, being the victim of a crime is always traumatic. Our team knows this better than anyone, and we’ll always be here to ensure that you don’t just get compensation for your losses, but that the guilty criminal is brought to justice.

Distracted Driving

Pennsylvania defines distracted driving as “an activity that could divert a person’s attention away from the primary task of driving.” Drivers have to focus on driving, so they can react to the information on the road, such as road conditions, hazards and other drivers. Distracted drivers do not react appropriately and thus put others at risk for severe injury or death. Examples of distractions, besides using cell phones and texting, include drinking, eating, adjusting the radio, adjusting climate controls, adjusting seats, combing hair, putting on make-up, daydreaming, reaching for dropped items, engaging in heavy conversations, and focusing on events outside of the car.

Driving Under the Influence

Driving under the influence typically refers to alcohol use, but drug use can also impair drivers and cause severe car accidents.  In either situation, enjoying cocktails at happy hour, celebrating with drugs or alcohol, drinking too much wine for dinner and unwinding after a long week at work results in too many motorists driving under the influence.  Controlled substances impact each person differently, making it common for someone to misjudge his or her level of impairment.  These poor judgments can lead to severe and sometimes fatal car accidents.

Driver Fatigue

Driving without enough sleep is commonplace for many in the Commonwealth of Pennsylvania and across the nation. Truck drivers, shift workers, and those with sleep disorders are most vulnerable to causing an accident because they are drowsy or fatigued. Not having enough rest slows down reaction time and impairs the senses. In fact, the Federal Motor Carrier Safety Administration (FMCSA) claims that eighteen (18) hours without sleep impairs a driver to the same extent as someone who has a 0.08 blood or breath alcohol concentration after consuming alcohol.

Speeding

The National Highway Transportation Safety Administration (NHTSA) estimates that one-third of all car accidents involve speeding. Drivers who rush, run late, or simply lack patience may choose to speed when they get behind the wheel. Speeding makes it more likely that a driver will lose control of his or her vehicle and makes it more difficult to react to road hazards and other vehicles. Speeding also increases the impact of a car accident and makes it far less likely that a negligent driver may maintain control of his vehicle sufficient to prevent a collision. High speed car accidents make it far more likely that those involved will suffer severe injuries or death.

OBTAIN NECESSARY COURT ORDERS TO PRESERVE EVIDENCE

At HoeyLegal, we know from our litigation experience that tractor-trailer drivers often operate at least one cellular phone which is in use at, during, or immediately prior to a tractor-trailer accident. Additionally, most tractor-trailers are equipped with data recorders which capture, in real-time, important vehicle operation events including speed, hard braking and other evasive maneuvers taken by the operator and the tractor-trailer.  It is imperative that this evidence be obtained before it is destroyed.  At HoeyLegal, our trial attorneys will obtain any necessary court order to preserve this evidence for trial.

IDENTIFY ALL AT-FAULT DEFENDANTS

Oftentimes, there are several defendants responsible for the tractor-trailer accident. In most cases, at least two defendants are responsible for the ownership and operation of the tractor-trailer.  There may be additional defendants responsible for the hiring and retention of the tractor-trailer driver.  At HoeyLegal, our investigators will promptly identify the responsible defendants and immediately request the preservation of all evidence related to the hiring and retention of the driver, inspection of the vehicles and the supervision and drug/alcohol testing of the vehicle operator.

LOCATE, EXAMINE AND INSPECT THE TRACTOR-TRAILER

Our accident investigators include mechanics who will immediately respond to the accident site and the location where the truck has been impounded in order to photograph the truck and conduct necessary mechanical inspections of the vehicle. In the event that a court order is necessary to examine and inspect the trucks, HoeyLegal Attorneys will promptly file the necessary motions to enable the HoeyLegal mechanics and inspectors to conduct a prompt evaluation of the mechanical function of the at-fault tractor-trailer

ACCIDENT RECONSTRUCTION

Our expert accident investigators include former Pennsylvania State Police accident investigators and nationally recognized engineers who will carefully photograph the accident scene and conduct all necessary measurements of skid marks, yaw marks, displacement of debris and thoroughly examine the accident site to preserve all evidence for the time of trial.

INTERVIEW ALL WITNESS

Our investigators will promptly interview and record all witnesses that observed the accident and collect all biographical information from the witnesses so they will available to testify on your behalf at trial.
