The Defendant was charged with aggravated assault, simple assault and lesser included offenses following an altercation with another individual outside of a West Chester bar. After a verbal altercation in the bar, the Defendant followed the alleged victim outside the bar and down the street where another verbal altercation ensued. The Defendant believed that he was going to be attacked by the man and his friends. The Defendant broke a beer bottle and swung it toward the alleged victim to keep him away and the jagged edge of the bottle struck the side of the alleged victim=s eye, causing a laceration and numerous stitches. Mr. Rubino was able to convince the jury that there was no intent on the part of the Defendant to injure the individual.
