The Defendant was charged with double homicide of two individuals during the course of a drug transaction. The Commonwealth sought the death penalty for Mr. DeJesus because his prior record included a felony aggravated assault conviction. Attorney Rubino, not relying upon the record itself, went into the archives of the Chester County Clerk of Courts to review the old aggravated assault case file and found that at the time of the Defendant’s aggravated assault plea there was no indication whether or not the plea was to a misdemeanor or felony aggravated assault charge.
