Woman Avoids One Year Mandatory Jail Sentence in a Third Offense D.U.I. Case

A Chester County woman was stopped and arrested for driving under the influence of alcohol. The Defendant was requested to give blood and refused after she was read certain rights and obligations from a form that was read to her by the arresting officer. Mr. Rubino filed a motion with the court alleging that the form failed to adequately advise the Defendant of the consequences of her refusal to give blood. The court agreed that the form was inadequate and dismissed the count calling for the mandatory one year incarceration upon conviction.
