Jury Finds Philadelphia Man Not Guilty of Armed Robbery

In the matter of Commonwealth vs. Rhoades, Mr. Hoey was successful in presenting an alibi defense demonstrating that Mr. Rhoades was in Philadelphia, Pennsylvania at the time a West Whiteland convenience store was robbed at gunpoint. Although the Commonwealth presented a store clerk who positively identified Mr. Rhoades in a photographic lineup, prior to trial, and again in the courtroom at trial, Mr. Hoey demonstrated that the store clerk’s ability to see the perpetrator was inhibited by time and distance. The jury returned it’s verdict shortly after deliberating and Mr. Rhoades was free to leave the courtroom and the custody of the Chester County Prison.
