Chester County Trial Court Suppresses Six Pounds of Marijuana

In the matter of Commonwealth vs. Frey, Mr. Hoey was retained as trial counsel in the Chester County Court of Common Pleas. Upon a review of the police reports and preliminary hearing testimony, Mr. Hoey prepared and successfully argued a suppression motion challenging the constitutionality of the police conduct which led to the recovery of over six pounds of marijuana in Mr. Frey’s vehicle. Chester County Court of Common Pleas Judge David Bortner suppressed the six pounds of marijuana recovered from Frey’s vehicle, finding that the search of the vehicle was unconstitutional and violated the Defendant’s Fourth Amendment right to be free from unreasonable searches and seizures.
